DMCA Copyright Policy

1Overview

TagAlong, LLC ("TagAlong") respects the intellectual property rights of others and expects users of the platform to do the same. Under the Digital Millennium Copyright Act of 1998 ("DMCA"), TagAlong will respond expeditiously to claims of copyright infringement committed using the TagAlong platform.

2Reporting claimed infringement (notice)

If you are a copyright owner or an agent thereof and you believe that any content on TagAlong infringes your copyrights, you may submit a notification pursuant to the DMCA by providing our Designated Agent with the following information in writing (see 17 U.S.C. section 512(c)(3)):

  • A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  • Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works.
  • Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, with information reasonably sufficient to permit TagAlong to locate the material (for example, the URL of the listing or message).
  • Information reasonably sufficient to permit TagAlong to contact the complaining party, including an address, telephone number, and email address.
  • A statement that the complaining party has a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and, under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

3Designated Agent

Notices of claimed infringement must be sent to TagAlong's DMCA Designated Agent:

The Designated Agent is registered with the US Copyright Office. Registration must be renewed every three years.

You may also submit a notice through the in-app report flow (Profile, then Report, then Copyright infringement). Submissions through that channel are routed to the Designated Agent.

4Counter-notification (restoration)

If you are a TagAlong user and material you posted was removed or disabled by TagAlong, and you believe that the removal was the result of mistake or misidentification, you may submit a counter-notification pursuant to 17 U.S.C. section 512(g)(3), which must include:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
  • A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, for any judicial district in which TagAlong may be found), and that you will accept service of process from the person who provided the original notification or an agent of that person.

Counter-notifications must be sent to the Designated Agent. Upon receipt of a proper counter-notification, TagAlong will provide a copy to the original complaining party and may restore the material in 10 to 14 business days unless the complaining party files an action seeking a court order against the user.

5Repeat infringers

TagAlong has adopted a policy of terminating, in appropriate circumstances and at its sole discretion, users who are deemed to be repeat infringers. TagAlong may also at its sole discretion limit access to the platform and terminate the accounts of any users who infringe the intellectual property rights of others, whether or not there is any repeat infringement.

6Misrepresentations

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be subject to liability.
